An analysis of what’s working at the USPTO for overcoming 101/Alice rejections. The authors reviewed approximately 3600 Class 705 patent applications that issued since the Alice decision, and found approximately 270 that overcame a 101/Alice rejection during prosecution. The Alice rejections and associated Applicant responses in about a quarter of these applications were reviewed, and the arguments were analyzed and categorized into a set of argument types. The presentation discusses and provides examples of these argument types.
Steve is an Intellectual Property attorney with a practice that emphasizes patents and trademarks. His background includes over 28 years of experience in the engineering field, including senior management roles at venture capital-funded startups and FORTUNE 500 companies (most recently with Intel).
