Intellectual Property Strategies in the Wake of Alice

Following the Supreme Court’s June 2014 decision in Alice Corporation v. CLS Bank, software remains eligible for patent protection. However, many existing patents have been invalidated as unpatentable “abstract ideas” under the Alice framework and experience shows that it is now much more difficult to obtain software patents from the USPTO.
This panel discussion will address Alice’s impacts in its first year and strategies for filing and defending patent claims in its wake. The panel will include Mel Chan, Aka Chan LLP; Dana Rao, VP of IP and Litigation, Adobe Systems; and Robert McFarlane, Partner, Hanson Bridgett; and moderated by Professor David Franklyn, Director of the McCarthy Institute, University of San Francisco, School of Law.
