An analysis of what’s working at the USPTO for overcoming 101/Alice rejections. The authors reviewed approximately 3600 Class 705 patent applications that issued since the Alice decision, and found approximately 270 that overcame a 101/Alice rejection during prosecution. The Alice rejections and associated Applicant responses in about a quarter of these applications were reviewed, and the arguments were analyzed and categorized into a set of argument types. The presentation discusses and provides examples of these argument types.
Steve is an Intellectual Property attorney with a practice that emphasizes patents and trademarks. His background includes over 28 years of experience in the engineering field, including senior management roles at venture capital-funded startups and FORTUNE 500 companies (most recently with Intel). Steve represents clients ranging from individual entrepreneurs and startups to industry-leading multinational corporations in the legal areas of utility and design patent procurement, trademark procurement, technology transfer due diligence, IP portfolio management, venture capital and IP portfolio pitch deck drafting, strategic patent counseling (e.g., infringement and enforcement matters, shelf-ready analysis and patent portfolio analysis), and patent litigation support.
