SVIPLA is pleased to announce our February presentation "Parallel Criminal and Civil Trade Secrets Disputes: What You Need to Know."

With federal and state law-enforcement agencies showing an increased interest in investigating and prosecuting trade secret misappropriation cases, we have seen a wave of recent trade secret cases that are the subject of parallel criminal investigations and civil lawsuits.  These parallel trade secrets proceedings present a unique set of strategic challenges and questions.  Should you refer a matter to criminal authorities if you believe you have been the victim of trade secret theft?  When should you make such a referral?  Should you file a motion to stay the civil litigation in light of an ongoing government investigation?  Should you seek preliminary civil relief in the face of an ongoing criminal investigation?  How best to coordinate and cooperate with the prosecutors when you are involved in parallel civil litigation with corresponding discovery obligations?  What are the factors to evaluate when considering whether to assert the Fifth Amendment?  Here to answer those questions, and others, are Neel Chatterjee, who was on the front lines of the Waymo/Uber trade secrets dispute, and Randy Luskey, who tried the Jawbone/Fitbit trade secrets case.

Neel Chaterjee is a partner in Goodwin’s Intellectual Property practice and serves on the firm’s Executive Committee.
